Sanderson, District Court Judge ou the application of Affidavit for Distribution of Estate or Decree Establishing l~ght and Title to Real Properly, as heretofore filed by the Petitioner, and the Coua, having reviewed the file of record and being duly advised in the premises, finds as follows: 1. That the aforesaid affidavit or application dated the 14"' day of July, 2004 filed with this Cou~ on the 20th day of July, 2004 in accord with ~2-1-205 W.S. (Lexis 2003) applied to this Cou~ for an order authorizing a summa~ procedure for distribution of certain real property described in ~11 hereafter, is sufficient, complete and in accordance with law. 2. That due and proper notice of this hearing has been given; and that there is on file in the record herein, an Affidavit of Publication showing compliance with ~2-1-205(c) (Lexis 2003). 3. That the above named Decedent died on the 7'h day o f November, 2002, in the City of Kailua, CounW of Honohdu, State of Hawaii. 4. That the Decedent died testate leaving surviving his heir at law, the lbllowing entity: Name Relationship Helep Petrovitch, Trustee of the Trust Vladimir Petrovich Living Trust dated August 25, 1995 5. That the Decedent died seized of an interest in and to the following real property: 1 I I 1 WVzSVzNVz~ of Section 33, T33N, RI19W of the 6th P.M., Lincoln County, Wyoming. TOGETHER WITH a right of way easement fi)r ingress and egress and all utilities to the said WV~SV2NVa~% described as the South 40 feet and the West 40 feet of the NVaNVzNE'A aud EhSVzNV2NE'A of said Section 33. S~JECT TO all easements, exceptions, restrictions, reservations and fights of way of si ght or record. ~obateM*etrovitchkDecree 10. 11. That no application for the appointment ora personal representative for the Decedent's estate is pending or has been granted in any jurisdiction. That the value of the entire estate of said Decedent, wherever located does not exceed one hundred fifty thousand dollars ($150,000). That more than thirty (30) days have elapsed since the date of death of the Decedent. That pursuant to the Affidavit for Distribution of Estate, the share of the right, title and interest of Decedent to said real property vested upon his death in Helen Petrovitch, Trustee of the Vladimir Petrovitch Living Trust dated August 25, 1995. That no objections, written or oral, have been filed with the Court by any party whomsoever, as to the above captioned matter. Based upon the aforesaid, the Court makes the following: CONCLUSIONS OF LAW That the Court has full and complete jurisdiction over the subject matter and all interested parties in this cause. That the file of record herein is complete and meets all the requirements of {}2-1-205 (Lexis 2003) for relief prayed for in the application. IT IS ORDERED, ADJUDGED AND DECREED that at the aforesaid date of death of the Decedent, Helen Petrovitch, Trustee of the Vladimir Petrovitch Living Trust, dated August 25, 1995 is entitled to this estate. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Helen Petrovitch, Trustee of the Vladimir Petrovitch Living Trust, dated August 25, 1995 is the present owner of its share or' interest in the below described real property, thereby vesting in said Helen Petrovitch, Trustee of the Vladimir Petrovitch Living Trust dated August 25, 1995 its share of the interest in the following described real estate situated in Lincoln County, State of Wyoming: W½S½N½NE¼ of Section 33, T33N, R119W of the 6t~ P.M., Lincoln County, Wyoming. TOGETHER WITH a right of way easement tbr ingress and egress aud all utilities to the said W ½S ½N½NE¼ described as the south 40 feet and the west 40 feet of the N½N½NE¼ and E½S½NV, NE¼ of said Section 33. SUBJECT TO all easements, exceptions, restrictions, reservatious and rights of way of si ght or record. Probate~etrovitch\Decree 2 -0472 IT IS FURTttER ORDERED, ADJUDGED AND DECREED that a certified copy o1' decree shall be recorded in the Office of the County Clerk; and thereafter the decree and record thereof shall be presumptive evidence of title to the property herein described. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that if any other real property is located that is not identified above, the Vladimir Petrovitch Living Trust, dated August 25, 1995 is entitled to that real property.
