Miller, President of Wyoming View, Inc., a Wyoming Corporation, the Managing Member of Indian Creek, LLC, a Wyoming Limited Liability Company, c/o 9800 Sorrel Avenue, Potomac, Maryland 20854-4743, being duly sworn and under oath, hereby stating as follows: 1. That Indian Creek, LLC is the owner of Lots 1, 2, 3, 4, 5, 6, 7, 8, and 9 in Indian Creek Subdivision, Alpine, Lincoln County, Wyoming, pursuant to a Warranty Deed that was recorded in the land records of Lincoln County, Wyoming on June 30, 2004 in Book 560PR at Pages 325 and 326 as Instrument No. 900603. 2. That Indian Creek Subdivision was created upon the filing of a plat in the land records of Lincoln County, Wyoming, said plat being captioned "INDIAN CREEK SUBDIVISION, OWNERS TOM VITEK AND JANE VITEK, DOYLE VAUGHAN AND DIANA VAUGHAN, BEING ALL OF THE W1/2SE1/4, SECTION 17, TOWNSHIP 37 NORTH, RANGE 118 WEST, LINCOLN COUNTY, WYOMING" and being recorded on September 22, 1994 as Plat No. 105-A. 3. That on May 12, 1997, a plat captioned "PLAT TO ACCOMPANY PARCEL DIVISION APPLICATION FOR THOMAS J. VITEK AND JANE E. VITEK, DOYLE R. VAUGHAN AND DIANA K. VAUGHAN, WITHIN THE W1/2SE1/4, SECTION 17, T37N, Rl l8W, LINCOLN COUNTY, WYOMING" was filed in the Lincoln County, Wyoming land records as Plat No. 219-B. The intent of the plat was, upon submission of an application, to AFFIDAVIT DECLARING PLAT 219-B VACATED PAGE 1 OF 2 ' .... 0771 divide the land comprising Indian Creek Subdivision into three parcels: Parcel A, comprising Lots 1 through 5, Parcel B, comprising Lots 6 through 9, and Lot 10, maintained as originally defined. 4. That to my best knowledge and information, no application and no Affidavit or Deeds were ever filed to change Indian Creek Subdivision as established by Plat No. 105-A. 5. That the effect of the filing of Plat No. 219-B has been to cloud the status of Indian Creek SUbdivision. 6. That as the owner of the affected property, specifically Lots 1, 2, 3, 4, 5, 6, 7, 8, and 9 of Indian Creek SubdiVision, I hereby declare, pursuant to Wyoming Statutes § § 34-12-106 through 34-12-110, that Plat No. 219-B is vacated, and request that the said plat be marked "vacated" by the Lincoln County Clerk to eliminate the clouding of the status of Indian Creek Subdivision.
