Thoman, ("Grantor"), hereby grants to PacifiCorp, an Oregon corporation, its successors and assigns, ("Grantee"), an easement for a right of way 10 feet in width and 1412 feet in length, more or less, for the construction, reconstruction, operation, maintenance, repair, replacement, enlargement, and removal of electric power transmission, distribution and communication lines and all necessary or desirable accessories and appurtenances thereto, including without limitation: supporting towers, poles, props, guys and anchor, including guys and anchors outside of the right of way; wires, fibers, cables and other conductors and conduits therefor; and pads, transformers, switches, vaults and cabinets, along the general course now located by Grantee on, over or under the surface of the real property of Grantor in~ounty, State of Wyoming, more particularly described as follows and as more particularly desct'fb'e'8'~n~or shown on Exhibit(s) attached hereto and by this reference made a part hereofi An easement across part of the NE ¼ SE ¼ of Section 3, T21N, Rll9W, 6th P.M., Lincoln County, Wyoming, said easement being 10.00 feet wide, 5.00 feet on each side of the following described centerline: COMMENING at the Northeast comer of said NE ¼ SE 'A (East one-quarter comer of said Section 3), running thence S 00o05'30'' E, 993.98 feet along the East line thereof; thence S 89°54'30'' W, 408.60 feet to the POINT OF BEGINNING; Thence N 87° 13'20" E, 319.79 feet to a point to be known as "POINT A"; Thence N 01°28'16'' E, 643.64 feet to a point to be known as "POINT B'" Thence N33°28'22'' W, 323.02 feet to the POINT OF ENDING of this portion of the easement. Also, BEGINNING at "Point A", running thence S 01o28, 16" W, 35.00 feet to the POINT OF ENDING of this portion of this easement. Also, BEGINNING at "Point A", running thence N 87°13'20'' E, 70.00 feet to the POINT OF ENDING of this portion of the easement. Also, BEGINNING at "Point B", running thence N 73059'58'' E, 21.00 feet to the POINT OF ENDING of this portion of easement. Said easement being 1412.45 feet, more or less in length. Assessor's Map No. Tax Parcel No. :0834 Together with the right of access to the right of way from adjacent lands of Grantor for all activities in connection with the purposes for which this easement has been granted; and together with the present and (without payment therefor) the future right to keep the right of way and adjacent lands clear of all brush, trees, timber, structures, buildings and other hazards which might endanger Grantee's facilities or impede Grantee's activities. At no time shall Grantor place, use or permit any equipment or material of any kind that exceeds twelve (12) feet in height, light any fires, place or store any flammable materials (other than agricultural crops), on or within the boundaries of the right of way. Subject to the foregoing limitations, the surface of the right of way may be used for agricultural crops and other purposes not inconsistent, as determined by Grantee, with the purposes for which this easement has been granted. The rights and obligations of the parties hereto shall be binding upon and shall benefit their respective heirs, successors and assigns; and this easement shall temainate if and when Grantee shall have abandoned all use of the right of way and no longer has any future need therefor.
