7. That Lessee acknowledges receipt of above equipment in good order a~d c,mdition, and upon the expiration of the'term of this lease agree-
ment, or upon the sooner termination of this lease agreement, the Lessor, withtmC the necessity of giving f~rther notice, shall be entitled to the
immediate possession of said personal property, and the Lessee shall thereupon d~d iv~' said personal property to the Lessor at the location specified
above, in good order and condition, ordinary use, wear and tear thereof excepted. That anything on tires, such as cuts, breaks, etc., shall be defined
as excessive tire damage and shall be at the Lessee's expense.
8. That the Lessee hereby agrees to be responsible and liable for loss, d,mage and destruction of said personal property, from any cause
whatsoever, until the same be redelivered to Lessor. Lessee shall also indenmify a~d save Lessor from any and all personal injuries, damages,
claims, suits, costs and recoveries of every name and nature, including attorney l'~es, which may in any manner arise or grow out of the operation
or use of the personal property described above during the term of this lease; a,~d in the event any suit or action shall be brought against Lessor
to recover on account of such loss, damage, injury or destruction, Lessee shall aiqmar and defend any such suit or action and pay any judgement
that may be obtained against Lessor.
9. That the Lessee shall have the right to make any reasonable and law£ul ~se of the personal property described above, and shall take
reasonable and proper care thereof, and at its own cost and expense, make all ~ecessary repairs and replacements. That Lessor may inspect said
personal property at any time or place and Lessee agrees to pay Lessor in cash £~r a~y parts or labor furnished by or purchased from Lessor that
are necessary to keep said personal property in good and efficient operating c.~dition.
10. That in the event of any default by Lessee in any of the terms of this ~greement, this lease shall terminate immediately at the option
of the Lessor.
11. No insurance, license, sale or use taxes are included in the rental r~des.
12. That in the event default is made in the performance of any of the tm'ms, convenants or conditions of this lease agreement, it is expressly
agreed that Lessor, its agents or assignees, may enter upon any premises whe~'e said personal property is stored or located, using reasonable force,
and take possession thereof, without previous demand or notice and end ami lerminate this agreement, and that to accomplish the retaking of
said personal property Lessee agrees that Lessor can enlist the aid o£ any law tmf. rcement officer of the State of Montana or of any state where
said personal property may be located and that Lessor can deliver a cbpy of this le~se ago'cement to.said law enforcement officer and this agreement
shall be his authority to retake possession of the above-described personal prt,t~erty a nd to redeiiver it to Lessor. That Lessee shall be responsible
for paying any expenses incurred by Lessor in taking possession of said perso~ml p~'operty in case of default.
13. That if it is necessary to refer the collection of payments due under this Agree~nent to a collection agency or an attorney, the Lessee
agrees to pay, in addition to the payment dues under the terms of this lease ~d the legal interest, a collection charge in the amount of 20% of
the payments and interest then due. In addition, if it is necessary for Lessor to h i~'~ a~ attorney to institute a legal action against Lessee, the Lessee
agrees to pay a reasonable attorney fee as well as allowed court costm
14. That Lessee agrees that this lease agreement shall not be assigned m,r a~y interest in the said personal property sublet, by any act of
the Lessee, either by voluntary act or by operation of the law, without the w~-it(~ pm'mission of the Lessor. Any attempt by Lessee to assign this
agreement or to sublet or to otherwise encumber or dispose of any portion of th~ l~crso~ml property above-described, shall be deemed to be a breach
of this lease agreement, and the Lessor shall have the right and option to t~,r~n~mte this agreement immediately.
15. It is mutually agreed that time and exact performance of all the t~rms and conditions of this lease shall be an essential part of this
agreement and that all of the terms and conditions herein contained shall ex~md to and be obligatory upon the heirs, executors, administrators,
successors and assigns of the respective parties thereto. It is hereby expressly agreed that, if Lessor should have a buyer for subject equipment,
Lessor shall be entitled to possession of subject rental equipment with termi~m~ion of lease on 10 days notice to Lessor.
