England and Carol Engh, mi. husband and wife, as tenants by the entireties, ("Grantor") for a good and valuable consideration, t t lc receipt of which is hereby acknowledged, do hereby grant, convey and warrant unto Lower Valley Encrvv. a Cooperative Corporation, of Alton and Jackson, Wyoming and to its successors and assigns, ("Grantees" ~, a perpetual easement and right of way for the construction and continued maintenance, repair, ,Iteration and replacement of the electric distribution circuits, lines and equipment of the Grantee to bc c~mstructed and maintained under, upon and across the premises of Grantor in Lincoln County, State of '~X ) o,ning, along a line described as follows, to wit: BEING a portion of the Hudson L. and Carol England plat. I tact-A3, revised; and Tract A-1.1, revised within Section 24, T31N, R119W, in Lincoln County, Wyomm~ more particularly described as follows: BEGINNING at a point being 73 feet North of the SE cornc~ of said Tract A-3, at an existing junction vault, thence S 00© 06'4Y'W, 73 feet to a point. This portion ol casement to include a strip of land 20 feet in width running parallel with East line of said Tract A-3. Thence ,', 51 °W, 68 feet; thence S 3°W, 489 feet; Thence S 55°W, 38 feet; thence S 85°W, 172 feet to a transl,}rmcr location. This portion of easement to include 10 feet on each side of described line. RIGHT-OF-WAY together with all necessary and reasonable riL, hts of ingress and egress and to excavate and refill ditches and trenches for the location and repair of sa ~,1 lhcilities and to cut, thm, spray herbicides, or remove trees, shrubbery, undergrowth or other obstmction.~ interfering with the repan- and maintenance of the facilities. The Grantor acknowledges that Electhc and Magnetic F~cld, (EMF) are naturally occurring in the transmission or distribution of electricity, and that the Grantee l~zt~; here notified Grantor that EMF testing and information is available upon request fi-om the Grantee. Iris Easement by Grantor is intended to include so much space as is necessary or appropriate to the prc.,cnce of EMF and reasonable operation of the Grantee's distribution lines. Grantor agrees that all poles, wires and other facihfies, installed on or under the described lands shall remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expense. The rights, conditions and provisions of this easement shall int,-c to the benefit of and be binding upon the parties, their heirs, executors, admini.qtrators, successors and a.,s~gns. Grantor shall compensate Grantee for any damages to Grantee's facihties caused by Grantor, including payment of Grantee's attorney fees if action is undertaken by Grantee to enforce the commitments &.~,cribed in this easement. Grantor reserves the right to improve, occupy and use this easement for all purposes not inconsistent with the easement grant. Each party shall have the remedy of specific performance regarding this easement. The rights and obligations described in this easement shall run with the land I'his easement is not exclusive, and Grantor retains all rights not specifically granted by this easemem. This is the entire agreement of the parties regarding this easement, except as may be set forth in writing allot the date of this easement and signed by the parties.
