RIGHT-OF-WAY Width 10 feet on each side of described Ii,c, together with all necessary and rem~onatde nights of ingress and egress and to excavate and refill ditches an d trenches for the location and repair of s~ id facilities and to cut, trim, spray herbicides, or remove trees, shrubbery, undergrowth or other obstractio'~s interfering with the repair and maintenance of the facilities. The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring m li~e ~:ansmission or distribnfion of electricity, and that the Grantee has here notified Grantor that EMF testiag and information is available upon request fi:om the Grantee. This Easement by C_n'antor is hatextrled to /n¢lude so much space as is necessary or appropriate to thc presence of EMF and reasonable opemlJon )f Ihe Grantee's distribution lines. Grantor agrees that all poles, wires and other facilities, installed on or under the described lands sh:dl remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's e:,rpen e. The fights, conditions and provisions of this easement shall mute to the benefit of and be binding u'~on ~ ae parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Cn-m~tee: or any damages to Grantee's facilities caused by Grantor, inch,ting payment of Grantee's attorney fees if action is ~mclerlaken by Grantee to enforce the commitments described in this easement. Grantor rescua-es the right to improve, occupy and use this easement for all pm-p~,scs not inconsistent with the easemer.t groat. Each party shall have the remedy of specific performance regarding this easement. The rights a ad obligations described in this easement shall nm with the land. This easement is not exclusive, and Gran.or retains all rights not specifically granted by this easement.
