KING, also known as DREW KIN( ;. being of legal age and first duly sworn, deposes and says as follows: o That I reside in the Town of Diamondville, Lincoln (',runty, Wyoming and hereby make this Affidavit of Scrivener's Error or Corrective Affidavit ]m rsuant to § 34-11-101 W.S. I have knowledge of the facts set forth herein below in Ibis alT/davit as I am the same FRANCES D. KING mentioned in the Deeds that I make reference to ~n this affidavit and am competent to testify concerning these facts in open court. As set forth in the Deed dated August 17, 1965, 'my decc:~wd husband and I acquired real property from The Kemmerer Coal Company. A copy of the Dec, t cviden crag our acquisition was recorded in the Office of the Lincoln County Clerk on August 26 1%5 as Instrument Number 390444 in Book 71PR at Page 175. The legal description of that properb ~s properly described as follows: That portion of Parcel Thirty-two (32) of thc I',~x~ n of Diamondville, Lincoln County, Wyoming, as surveyed, platted and recorded, and more particularly described by metes and bounds as follows: Beginning at the Northwesterly comer of Lot Seven (7) in Block Five (5) of the Town of Diamondville, thence South 11© 10' East along Ibc westerly boundary of Lots Seven (7), Eight (8) and Nine (9) of said Block Five (5), a di~lance of 90.00 feet; thence South 78° 50' West, a distance of 30.00 feet; thence North 11~ 1(t' \Vest, a distance of 90.00 feet; thence North 78© 50' East, a distance of 30.00 feet to thc point ofbeginmng. My husband, Robert Damell King and I then convex, cd )v \Varranty Deed the same property described above to my father-in-law and mother-in-law, l ),mm'an Darnell King and Mary O. King on July 17, 1970. That Warranty Deed was recorded in thc ~ )/'rice of the Lincoln County Clerk on July 17, 1970 as Instrument Number 424168 in Book 91PR a~ Page 29. The legal description in that Warranty Deed was correct. Probate\King,Affidavit of Scr/vener's Error Donovan Damell King died on February 27, 1973 and his d:mh was made part of the public record by the Affidavit To Establish Right of Survivorship complclcd by his surviving spouse, Mary O. King on November 29, 1974. That affidavit correctly reK'~'cnccs the legal description of the real property at issue in this affidavit and was recorded in thc ~ )1 l'icc of the Lincoln County Clerk on November 29, 1974 as Instrument Number 461972 in Book I 1 ¢,PR at Page 171. That Mary O. King, a/k/a Mary Osboum King, my mother-in~ la w, conveyed by Warranty Deed the same property described above in Paragraph 3 of this alT/davit to herself, my husband, Robert Damell King and me, Frances Drew King as joint tenants. On March 29, 1982, Mary O. King, a/k/a Mary Osl),mrll King, my mother-in-law, conveyed by Warranty Deed the same property described above in Paragraph 3 of this affidavit to herself, my husband, Robert Darnell King and me, Frances Drew King as tenants by the entireties. That Deed was recorded in the Office of the Lincoln County C'M'k on September 24, 1982 as Instrument Number 585014 in Book 192PR at Page 291 and incorrc c ti 3' m a kcs reference to the portion of Parcel Thirty-two (32) where the legal description is set fox'ti: ~,~ beginning at the northwesterly corner of Lot 7 in "Block 4" instead of,Block 5".
