RESOLUTION 2005-1
WHEREAS, a petition was filed with the Town Council of the Town of
Diamondville, County of Lincoln, State of Wyoming, by a majority of the property
owners within three hundred (300) feet and praying said Town Council to vacate a parcel
of land within the corporate limits of the Town of Diamondville, County of Lincoln, State
of Wyoming, known as a section of West 2nd Avenue from the 1942 plat of
Diamondville, bounded on the east by Parcel 195 and on the west by the easterly highway
right-of-way which is made a part of this resolution by this reference as though recited
herein word for word; and
WHEREAS, it having been shown to said Council by satisfactory evidence that
the portion of said street to be vacated has never been used by the public, and the same is
not necessary for use by the public; and
WHEREAS, that all property owners, as well as the public generally, have had
due notice of the Town Council's request to vacate said street through publication in the
local newspaper for a public hearing, held on October 4, 2004 and no objections having
been made or filed at the public hearing.
BE IT THEREFORE RESOLVED, by the Town Council of the Town of
Diamondville that said portion of West 2nd Avenue, as described in the legal description
'attached hereto and referred to as Attachment A, and the same is hereby vacated.

A Parcel of land being a portion of West Second Avenue of tine Town of
Diamondville, Wyonfing as identified on the 1942 plat of tile Town of
Diamondville on file in tile Lincoln County Clerk's Office in Kemtnerer,
Wyonfing and being that portion of said West Second Avenue bounded on
the east side by Parcel 195 of said 1942 plat of the Town of Dimnondville
and bounded on tine west by the presently existing east side right of way
boundary of U.S. Highway 30-189 and being more particularly described
as follows:
Commencing at tile northwest corner of Parcel 4 of a particular parcel of land
described and on file at the Lincoln County Courthouse, recorded in book 274
on page 468, where is found an aluminum survey cap; thence N78"56'E along
tine northerly boundary of said Parcel 4, 30.00 feet to a point. Said point being
tine northeast corner of said parcel and the northwest comer of Lot 10 of Block
22 of said 1942 Plat of Diarnondville. Thence S 1 l°04'E along the westerly
boundary of said Lot 10, 140.00 feet to tine southwest conner of said Lot 10;
thence continuing S 1 l°04'E, 194.02 feet to the Point of Beginning of this
description. Said Point of Begimling being the northwest comer of Parcel 195
as per said 1942 Plat of Diamondville. Thence continuing S 1 l°04'E, 306.11
feet to a point. Said point beiug the intersection of the westerly boundary of
Lot 10 Block 28 of said 1942 Plat of Diamondville and the easterly Highway
Right of Way as described and recorded in Book 8 Page 426 on file at the
Lincoln County Courthouse. Thence N I7°19'08"W along the easterly boundary
of said Highway Right of Way, 24.70 feet to the point of curvature of a curve
to the right~ the radius of said curve being 3719.7 feet and bearing N72°40'52"E.
Thence northerly 234.01 feet along tine arc of said curve to tl~e right, tln'ough a
central angle of 3°36'17" to a point on the curve. Thence continuing 47.57 feet
along the arc of said curve to the right tlu-ough a central angle of 0°43'58";
Thence N77°01 ~06"E, 22.75' to the point of begimfing of this description. The
area of tine parcel described herein being 0.094 acres more or less.
