BERGAMO, Grantor, of Humcane, Washington County, Utah, hereby CONVEYS and WARRANTS to FRED C. BERGAMO, TRUSTEE, OR HIS SUCCESSORS IN TRUST, AS TRUSTEE OF THE FRED C. BERGAMO TRUST CREATED UNDER AGREEMENT DATED JANUARY 18, 2005, Grantee, of Hurricane, Washington County, Utah, without consideration, the following described tract of land in Lincoln County, State of Wyoming, hereby releasing and waiving all rights under and by virtue of the homestead exemption laws of the State, to-wit: That part of the Southwest Quarter of the Southeast Quarter of Section 22, Township 36 North, Range 119 West, Lincoln County, Wyoming, being part of that tract of record in the Office of the Clerk of Lincoln County in Book 278 of Photostatic Records on Page 582, described as follows: BEGINNING at a point on the Westerly right-of-way line of U.S. Highway 89, North 87°55'32'' West, 1334.65 feet from the Southeast comer of the Southeast Quarter of said Section 22, found as described in the Col'ner Record filed in said Office; thence North 25°13 '31" West, 418.66 feet, along said Westerly right-of-way line, to a pOint; thence North 89°03 '08" West 1073.82 feet to a point on the West line of said tract of record; thence coursing the Westerly and Southerly lines of said tract as follows: South 02°42'34" East, 226.43 feet to a point; South 02°05 '30" East, 149.98 feet to a 1" iron pipe with yellow plastic cap inscribed "RLS 595"; South 88°51 '52" East, 895.56 feet to a point; South 89°32'47" East, 340.55 feet to the POINT OF BEGINNING. The BASE BEARING for this survey is a tie from the Southeast corner of Section 22 to a Morley (RLS 595) survey marker found in the top ora right-of-way fence post, being North 87°55 '26" West; Page 1 of 2 Pages each "point" 1harked by a 5/8" x 24" steel reinforcing rod with a 2" aluminum cap inscribed "SURVEYOR SCHERBEL LTD BIG PINEY WY PLS 5368," with appropriate details; all in accordance with the plat prepared to be filed in the Office of the Clerk of Lincoln County titled "PLAT TO ACCOMPANY PARCEL DIVISION APPLICATION FOR HARVEY F. FINKELSON AND BARBARA E. FINKELSON WITHIN THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER SECTION 22 T36N R119W LINCOLN COUNTY WYOMING," dated 4 October 1994 and revised 8 July 1996. SUBJECT TO reservations and restrictions contained n the United States Patent and to easements and rights-of-way of record or in use. Together with all improvements and appurtenances thereon. By this Warranty Deed, it is Grantor's intention to convey that same property, without any exception described in that certain Warranty Deed dated October 5, 1998, and recorded in Book 419 at Page 070.
