In accordance with Wyoming Statutes (W.S. 18-5-306) 1977 as amended, comes now, Cendant
Mortgage Corporation, acting through its undersigned officer whose office is at 4001 Leadenhall Rd.
SV-13, Mt. Laurel, New Jersey 08054, who being duly sworn on oath according to law, does hereby
make the following statement of facts and affirm:
That Said Bank holds the Mortgage of record in the office of the Clerk of Lincoln County,
WYoming, in Book 564PR, on Page 528 of a Mortgage dated August 05, 2004 and recorded on
August 11, 2004 in the OffiCe of the Clerk of Lincoln County, Wyoming, as referred to in the Deed
recorded in Book 417PR, Page 411, with said Office.
That on behalf of said Bank the Amendment to the Subdivision is with our free consent and
desires.
That the name of the subdivision shall be the Alpine Village Subdivision #1 Plat 3 Amended
Fifth Filing, the metes and bounds being more Particularly described in the Certificate of
Owners:
That no public or private d'iility entity has thus far used or shown any plan or intention to use
the original easement locations, and thus there is no vested interest on the part of any utility
pertaining to the exact easement locations along Lots 64 and 65.
That the owners of Lots 64 and 65 agree to and hereby do vacate the original 10 ft. easement
along the common lot line between Lots 64 and 65 and establish in their place an equivalent
20 fi. easement for public and private utilities along the line between Lots 89 and 90 Alpine
Village No. 1 Plat 3 Amended Fifth Filing
That they respectfully request the Clerk of Lincoln County to appropriately mark that portion of
the official plat of said Subdivision "MODIFIED" With the appropriate reference to the
recordation of this document;
And that this modification of easement shall not abridge or destroy any of the rights and
privilege of other owners and proprietors in the Alpine Village No. 1 Subdivision Plat 3
Amended.
That the Utility Right-of-Way Easements as shown on said Plat are and shall be granted to the
owners, successors and assigns of each land parcel created.
That all rights under and by Virtue of the Homestead Exemption Laws of the State of Wyoming
are hereby released.
