LUTHY, having a mailing address of 120 E. Elk Street, Kemmerer, Wyoming 83101 ("Grantee"), WITNESSETH, that Grantor, in consideration of Forty Five Thousand and 00/100 Dollars ($45,000.00) and other valuable consideration paid by Grantee, does hereby grant and release unto Grantee, the heirs or successors and assigns of Grantee forever, ALL that certain plot, piece or parcel of land referred to as 1003 Elkol Street, Kemmerer, Wyoming, Parcel Number: 1250000426050 and as more fully described on Exhibit A attached hereto, together with the buildings and improvements located thereon, TOGETHER with all right, title and interest, if any, of Grantor in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all of the estate and rights of Grantor in and to said premises; THIS conveyance is expressly made subject to easements, restrictions, limitations and reservations of record, and shall further be subject to the restrictive covenant that the Subject Property shall not be used for the retail or wholesale sale and/or distribution o f 1 iquefied petroleum (LP) G as b y Grantee, by a ny tenant o f t he Subject Property, or by any subsequent purchasers acquiring the Subject Property for a period of ten (10) years from the date of this deed; TO HAVE AND TO HOLD the premises herein granted unto Grantee, the heirs or successors and assigns of Grantee forever. This being the same property conveyed to Grantor from Quantum Chemical Corporation by deed dated March 5, 1996 and recorded on May 20, 1996 in Book 383 PR, Page 402, No. 820042 at the Lincoln County Recorder's Office.
