GEN Clerk of District ORDER APPROVING FINAL REPORT, ACCOUNTING AND DECREE OF DISTRIBUTION TRUDY LYN CLOWARD, as the duly appointed, qualified and acting Personal Representative for the above-captioned Estate, having on February 9, 2005, rendered and filed a full account and report of her administration of said estate, which Final Account contained a Petition for Distribution of said estate, and Waivers of the Notice and Heating on said Final Account having been filed byall heirs of the Decedents, this Court FINDS: 1. Jurisdictional Facts and Governing Instmment. WYO. STAT. ANN. ~ 2-7-811(b)(ii) (LEXISNEXIS 2003). The above named decedent passed away on the 4th day of April, 2004, in Salt Lake City, Utah, and at the time of death was a resident of Natrona County, Wyoming, and owned an interest in assets subject to administration in Natrona County, Wyoming. The said decedent died testate. 2. Identification of Surviving Spouse. Who. STAT. ANN. [~ 2-7-81 lCtii); 2-5-101 (LEXISNEXIS 2003) The decedent left a no surviving spouse. 3. Heirs-at-law. The Personal Representative duly published legal notice of probate of this Estate, the first publication thereof being on the 6th day of June, 2004; the time for filing claims ha this estate has heretofore expired; and no claims have been filed in this estate. The Personal Representative has not sold any assets of the decedent or this estate in the administration of this estate. 6. Accounting, 'kX?Yo. STAT. ANN. ¢ 2-7-811(b)(ix) (LEXISNEx~s 2003). That a tree, accurate and complete accounting of all cash receipts and disbursements had and made to date by the Personal Representative with respect to this estate has been completed. 7. Statement of Compliance with all Stamto .fy Requirements Pertaining to Taxes. '~rYO. STAT. ANN. ~ 2-7-811(b)(x); 2-7-812 (LEx~SNEXIS 2003~ The estate was not required to file a United States Estate Tax Remm Form 706. The Personal Representative has duly filed the required reports with the Wyoming Department of Revenue and Taxation relative to Inheritance Tax in connection with this estate, and there is no inheritance tax owed. The decedent's United States Income Tax Remm for 2004, Form 1040, was or will be duly and tim_ely filed by the decedent's Personal Representative, and the income tax due thereon fully paid, if any. To the best knowledge, information and belief of the Personal Representative, no other taxes whatsoever are due or owing by or on account of said decedent, or by reason of said decedent's death, or by or on account of this estate. 8. Fees and Costs. As shown by the file of record herein, the Personal Representative and the attorney for the estate have filed a petition for the payment of fees and costs, and an Order has been granted herein. 9. Assets for Distribution and Proposed Distribution Thereof. WYO. STAT. ANN. ~ 2-7-811(xi) (LEsasN~.x~s 2003). There is marked Exhibit "A", attached hereto and by this reference incorporated herein, a statement of the assets available for distribution upon the closing of this estate and a schedule of proposed distribution relative to said assets. 10. Real Property. The decedent died seized of the following real estate: Tract 19, Riverside Acres, Natrona County, Wyoming. Said real estate has been appraised at $205,800 and has not been sold or conveyed by the Personal Representative. The decedent owned a fee simple interest in said property. In compliance with WYO. STAT. ANN. [ 2-7-811(b)(vi) (LExISNEXlS 2003), the Personal Representative states that no legacy or devise remains a charge on any of the aforesaid interests in any of the aforesaid real estate. 11. Waiver of Notice and Hearing on this Report. All of decedent's heirs have waived in writing the notice and hearing on this report required by WYO. STAT. ANN. ~ 2-7-204 (LEXtSNEx~s 2003). NOW, THEREFORE, IT IS ORDERED, ADJUDGED and DECREED the Personal Representative's Final Report, Accounting and Petition for Distribution is approved, and the residue of said Estate hereinafter particularly described on Exhibit "A", after payment of any items remaining due Order A pprozing Final Report, A amating and Dwr~e rfDistribution In Re' George W. Vi&tey Page 2 qc 4 and unpaid, and any other property not now known or discovered, and which may belong to said estate, or in which said estate may have an interest, be and the same is hereby set over to the parties designated on Exhibit "A"; and it is further, hereby ORDERED, ADJUDGED and DECREED that the following real propertyis set over to RONAI D W. VICKREY and GEORGE DAVID VICKREY, as tenants in common: Tract 19, Riverside Acres, Natrona County, Wyoming. and that it is further, hereby ORDERED, that when the Personal Representative has made distribution of this estate in accordance with this decree, she shall file the Receipts of the heirs, whereupon the Court will enter an Order releasing and discharging her and close this estate.
