Located within Section 30
Lincoln County, Wyoming

County of Lincoln
Jon D and Marsha L Caldwell of 9641 S 1835 E, Sandy Utah, who being duly sworn on oath accorking to law and
acting in their own right do hereby make the following statement of facts and affirm:
1. That the said Jon D and Marsha L Caldwell, in their own right as a married couple, are the sole owners of lot
59 plat 1 of the Star Valley Ranch Subdivision, as platted and recorded in the Office of the Lincoln County Clerk
of Lincoln County, Wyoming.
2. That the official Plat of the said subdivision provided for a 10 foot easement for Public and Private utilities
along the side and rear lot lines.
3. That the above owners of lot 59 have inadvertently constructed a home where the north east corner of the house
encroaches into the required 10 foot easement and offset on the east boundary of lot 59 but remains entirely within
the boundary of lot 59.
4. That no Public or Private Utility has thus far used or shown any intention to use the original easement locations,
and thus there is no vested interest on the part of any utility pertaining to the easement location along the lot 59
boundary.
5. That the owners of Lot 59 agree that if any future Public or Private Utility require use or access of this
easement, the above owners will be responsible for any costs associated with working around the encroachment.
6. That they respectfully request the Clerk of Lincoln County to appropriately mark that portion of the official plat
of said subdivision "modified" with the appropriate reference to this document.
7. And this modification shall not abridge or destroy any of the rights and privileges of other owners and
proprietors in the Star Valley Ranch Subdivision,
