Corsi, a single man, husband aud wife, ("Crrantor") for a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and warrant unto Lower Valley Energy, a Cooperative Corporation, of Alton and Jackson, Wyoming and to ils successors and assigns, ("Crrantees"), a perpetual easement and right of way for the construction ani continued maintenance, repair, alt~xation and replacement of the electric distrSbution circuits, lines mai equipment of the Grantee to be constructed and maintained under, upon mad across the premises of Granter in Lincoln County, State of Wyo]ning, along a line described as follows, to wit: BEING a part of NW1/4NV, rl/4 of Section 3, T3GN, RI 19W OF ~ 6TM PM in Lincoln Count3', Wyoming more accurately described as follows: BEGINNING East 106 feet, S31c'02'56"E 310 feet, N2°W 46 feet to an existing power pole from the Northwest comer of said NW 1/4NV¢ 1/4. Thence N 50°E, 27 feet to a point. Thence N 12°E, 97 feet to a transformer location. EASE/V[ENT to includel0 feet on.each side of described line, together with all necessary and reasonabl: rights of ingress and egress and to excavate and refill ditches and trenches for the location and reps ir of sai. facilities and to cut, la/m, spray herbicides, or remove trees, shrubbery, undergrowth or other obstruction s interfering with the repair and maintenance of thc facilities. The Grantor ackaaowledges that Electric mad Magnetic Fields (EMF) are naturally occurring in transmission or distribution of electricity, mad that the Crrantee has here notified Grantor that EMF testing and information is available upon request from the Grantee. This Easement by Grantor is intended t.) include so much space as is necessary or appropriate to the presence of ~ and reasonable operation of the Grantee's distribution lines. Grantor agrees that all poles, wires and other facilities, installed on or under the described lmads shah remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expense:. The rights, conditions and provisions of this easement shall inure to the benefit of and be binding upon th.' parties, their heirs, executors, administratnrs, successors and assigns. Grantor shall compensate Grantee for any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if action is undertaken by Ga~mtee to enforce the commitments described in this easement. Grantor reserves the right to improve, occupy and use this easement for all purposes not inconsistent with the easement gran':. Each party shall have the remedy of specific performance regarding this easement. The rights mad obligations described in this eas~tmt shall run with the land. This easement is not exclusive, and Granter retains all rights not specifically granted by this casement. This is thc entire agreement of the parties regarding this easement, except as may be set forth in writing after the date of this easement and signed br the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws cf Wyoming.
