Rorke and Rose Marie Dehaau-Rorke, husband and ~vife. as tenants by entireties, ("Grantor") for a good and valuable consideration, the receipt of which ~s hercb) acknowledged, do hereby grant, convey and warrant unto Lower Valley Energy, a Cooperative Corporat~ n, of A_fton and Jackson, Wyoming and to its successors and assigns, ("Grantees"). a perpetual easement a ad right of way for the constroctioa and continued maintenance, repair, alteration and replacement of' mc el¢clr/c dislribution circuits, lines and equipment of the Grantee to be conslructed and maintained u~d ~r, upon and across the premises of Gnmtor in Lincoln Couaty, State of Wyoming, aloag a line described as follows, to wit: BEING a part of the S 1/2NWl/4 6f Section 35, T36N, R119W, 6t~ P.M. in Lincoln County, Wyoming more accurately described as follows: - BEGINNING South 765 feet, East 54 feet fi.om the Northwest comer of said S IF2N'WI/4; Thence North 63 feet to a point. Thence East 352 feet to a point. Thence North 75 feet to a transformer location, EASEMENT to includel0 feet on each side of deacribed line, together with all necessary and reasonable rights of ingress and egress and to excavate and refill ditches and trenches for the location and repmr o~ sad fi~cilities and to cut, trim, spray herbicides, or remove trees, shrubbery, undergrow/h or other obsmm~ions interfering with the repair and maiatenance of the facilities. The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occun-ing in rte transmission or distribution of electricity, and that the Grantee has here notified Grantor that EIVae ~e.~:ur g and informaL/on is available upon request fi-om the Grantee. This Easement by Grantor is imended o include so much space as is necessary or appropriate to the presence of EMF and reasonable operanon ,f the Grantee's disthbufion lines. Grantor agrees that all poles, whys and other facilities, installed on or under the described lands shall remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expens,:. The rights, conditions and provisions of this easement shall inure to the benefit of and be binding upon I~ e parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Cn'antee any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees action is undertaken by Grantee to:chrome the commiunents described in this easement. Grantor reserves the right to improve, occupy and use this easement for all purposes not inconsistent with the easement grant. Each party shall have the remedy of specific performance regarding this easement. The nghts and obligations described in this easement shall run with the land. This easement is not exclusive, and Grantor retains all rights not apecifically granted by this easement. This is the entire agreement of the pamt.s regarding this easement, except as may be set forth in writing after the date oft.his easement and signed ky the parties.
